Case Details:

A pedestrian who suffered traumatic brain injuries after being struck by a New Jersey Transit bus settled his lawsuit with the agency for $2 million, according to his attorney, Beth Baldinger of Mazie Slater Katz & Freeman.

Kiliek Anthony was hit by the bus as he crossed Chancellor Avenue in Irvington to return to his car after using an ATM at about 6 a.m. on Dec. 1, 2015.

New Jersey Transit declined to comment on the settlement.

Witnesses said Anthony crossed in a crosswalk at the intersection of Coit Street and had a green light. Two passengers aboard the bus yelled out to the driver in an attempt to warn him a pedestrian was crossing, according to the mediation statement. 

Anthony was thrown 10 to 15 feet after being hit as his girlfriend and infant son waited in the car, the statement says. He suffered head, back, neck and facial injuries and experienced amnesia in the aftermath of the crash. 

The then 25-year-old also lost brain tissue and a part of his frontal brain lobe, which has caused him significant cognitive difficulties, according to the mediation statement. Anthony, who has since moved to North Carolina with his family, is no longer able to work or drive and has problems with vertigo and balance.

NJ Transit fired the bus driver, who allegedly had a poor driving record in his six months on the job.

Before being hit, Anthony had a job as a paraprofessional in a New York City public school, working one-on-one with special education students. He had also launched a business — Kidcasso — in which he hosted painting parties and art lessons for children in public parks, Baldinger said.

NJ Transit approved the settlement in August and paid Anthony in October.
